Control in a World of Algorithmic Management and the Future of Labour and Employment Law

AI and algorithmic management and supervision of service providers are attracting attention. One reason for this is the question of whether labour laws and regulations can be applied to such work, especially as it relates to platform-based work. Another is that such AI and algorithmic supervision of workers is expected to invisibly raise serious issues, such as the collection of workers’ information, invasion of privacy and discrimination against workers.
This symposium relates more directly to the second of the above issues. In other words, from the perspective of information engineering, business administration, and philosophy of law, this symposium considers two typologies of decision-making processes that link workers to the tasks performed by AI/algorithms that are increasingly introduced and will be deployed in the workplace of the future: one where decision-making criteria are predetermined and procedural fairness is ensured in advance, and another where such criteria emerge through the process itself and the fairness of decisions can only be evaluated retrospectively. These typologies can be seen as presenting fundamental challenges to our conventional understanding of fairness in actual work settings.
The decision-making effects of such technologies differ in no small measure from the human command and control on which traditional labour law and regulation have been based. Therefore, the introduction and deployment of such technologies in the workplace is likely to face a gap with the underlying fairness of traditional labour law and regulation and the justifications for legal regulation.
This symposium will show and discuss what challenges to existing labour law rights have arisen from the development of debates and movements in the UK and Japan, and the grounds and forms of existing regulation that can accommodate the introduction and deployment of such technologies in the workplace. It also discusses the characteristics of each technology in an interdisciplinary manner and considers new grounds for legal regulation and forms of regulation in line with each technology.
